STUDENTS
H-3 VISA

The H-3 visa is a nonimmigrant visa allowing you to come to the United States to receive instruction or training. The training cannot be graduate medical education or training, and the training cannot be planned mainly to provide productive employment.

To receive an H-3 visa:

You must have a foreign residence that you do not intend to abandon.
You cannot be attending training which is available in your home country.
You cannot be taking the position of a U.S. worker.
You must not be performing productive employment unless it is secondary or necessary to the training.
The training program must benefit you in your career path outside of the U.S.

An H-3 visa will be issued for length of time necessary to complete the training program you intent to attend. This time period however will not be more than two years. With an H-3 visa, you may not receive any extensions or change your status unless you are physically absent from the United States and reside in another country for at least six months.
